Terms of Service

Last updated: 13 April 2026

1. Definitions

  • Breazy: the trade name of BreazyLabs B.V., Chamber of Commerce no. 96623055, established in Haarlem.
  • Client: the natural person or legal entity that enters into an agreement with Breazy.
  • Service: the AI-driven B2B lead generation platform and related services offered by Breazy.
  • Agreement: any written or electronic arrangement between Breazy and the Client concerning the provision of the Service.

2. Applicability

These terms of service apply to all offers, quotes and agreements under which Breazy provides services. Deviations are only valid if agreed in writing.

3. Provision of the Service

Breazy will make every effort to deliver the Service with due care. The Service constitutes a best-efforts obligation and not an obligation to achieve a specific result. Breazy does not guarantee any specific number of leads, appointments or revenue.

Breazy is entitled to (temporarily) adjust, expand or limit the Service, provided that the essential functionality is retained.

4. Obligations of the Client

  • The Client provides, in good time, all information necessary for the performance of the Service.
  • The Client uses the Service solely for lawful purposes and in accordance with applicable laws and regulations, including the GDPR.
  • The Client is not permitted to use the Service for spam, deception or other unlawful communication.
  • The Client is responsible for securing login credentials and bears the consequences of misuse by third parties.

5. Rates and payment

The rates are set out in the Agreement or quote. Invoices must be paid within 14 days of the invoice date, unless otherwise agreed. In the event of late payment, statutory commercial interest is due.

Breazy is entitled to adjust rates annually based on the CBS price index figures, after at least 30 days' written notice.

6. Term and termination

Agreements are entered into for the term stated in the quote. Upon expiry they are automatically renewed for the same period, unless one of the parties terminates the agreement observing a notice period of 30 days before the end of the current period.

7. Intellectual property

All intellectual property rights in the Service, the underlying software, algorithms and content vest in Breazy or its licensors. The Client obtains only a non-exclusive, non-transferable right of use for the duration of the Agreement.

8. Confidentiality

Both parties undertake not to disclose to third parties, without prior written consent, information that is designated as confidential or should reasonably be regarded as such.

9. Liability

Breazy's liability for direct damage is limited to the amount the Client has paid in the three months preceding the damage-causing event. Breazy is not liable for indirect damage, lost profits or consequential damage.

10. Force majeure

Breazy is not obliged to fulfil obligations if it is prevented from doing so as a result of force majeure, including outages at internet providers, data center failures, DDoS attacks and government measures.

11. Applicable law and dispute resolution

Dutch law applies to all agreements. Disputes will be submitted to the competent court in the Noord-Holland district, unless the parties opt for mediation.

12. Amendments

Breazy reserves the right to amend these terms of service. Amendments are communicated to the Client in writing or by email at least 30 days in advance. In the event of objection, the Client has the right to terminate the Agreement as of the date of entry into force.
